Robert Miller maintains a diverse litigation practice with the Firm as a senior attorney, but is especially familiar with the problems faced by real estate brokers and salespersons in Texas. He devotes a significant portion of his litigation practice to defending real estate agents sued by unhappy buyers and sellers across the entire State of Texas.

In addition, Mr. Miller has substantial experience representing large and small businesses, commercial enterprises, professional associations, homebuilders, and homeowners' associations in both state and federal courts on issues including consumer deceptive trade practice actions, employee noncompete agreements, business litigation, breach of contract, real estate matters, and bankruptcy. Mr. Miller is especially versed in issues involving commission disputes for real estate brokers, and has successfully argued many cases that have resulted in full recovery of a commission by a broker.

Mr. Miller has compiled extensive experience in representing both debtors and creditors in all areas of bankruptcy and reorganization. He assists debtors by focusing on the circumstances that placed the debtor in financial difficulty and evaluating the validity of restructuring a debtor's organization and debt so that they may continue business on certain levels. In a similar vein, he works with creditors by discerning ways to protect the creditors' interests, both within and without the bankruptcy system.

Also, Mr. Miller has successfully enforced and defeated the enforcement of employee covenants not to compete, along with defending companies from employee discrimination complaints.


Mr. Miller was born in Iowa. Prior to joining Prager, Metzger & Kroemer PLLC, Mr. Miller gained experience in federal administrative and securities law as in-house counsel for a New York Stock Exchange listed company.

An active sailor, Mr. Miller crews on several sailboats and travels throughout the country to race in regattas. When not sailing, he is involved in state and local politics, serving as an elected precinct chair and being an elected delegate to state political conventions. He also is active in his local homeowners association, the Plano Homeowners Council, and Texas Neighborhoods Together.
